The data controller, as defined in Article 4, Point 7 of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons concerning the processing of personal data and on the free movement of such data (hereinafter referred to as “GDPR”), is Bc. Personal data refers to all information about an identified or identifiable natural person; an identifiable natural person is someone who can be directly or indirectly identified, particularly by reference to a specific identifier such as a name, identification number, location data, online identifier etc.

Sources and Categories of Processed Personal Data

 

  1. The controller processes personal data that you have provided or data that has been obtained in connection with fulfilling your order.

  2. The controller processes your identification and contact information and any data necessary to fulfill the contract.

Legal Basis and Purpose of Personal Data Processing

  1. The legal basis for processing personal data is:

    • Fulfillment of the contract between you and the controller under Article 6(1)(b) GDPR
    • The controller’s legitimate interest in direct marketing (especially sending commercial communications and newsletters) under Article 6(1)(f) GDPR
    • Your consent to data processing for direct marketing purposes (including sending commercial communications and newsletters) under Article 6(1)(a) GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on certain information society services, in cases where no order for goods or services has been placed.
  2. The purpose of processing personal data is:

    • Processing your order and fulfilling rights and obligations arising from the contractual relationship between you and the controller; providing personal data is a requirement for entering into and performing the contract. Without providing personal data, the contract cannot be concluded or fulfilled by the controller.
    • Sending commercial communications and conducting marketing activities.
  3. The controller does not engage in automated individual decision-making as per Article 22 GDPR. You have explicitly given your consent for such processing.

IV.

Data Retention Period

  1. The controller retains personal data:

    • For the period necessary to fulfill rights and obligations arising from the contractual relationship between you and the controller and to assert claims from these contractual relationships (for 15 years after contract termination).
    • Until consent to data processing for marketing purposes is revoked, but no longer than 10 years, if the data is processed based on consent.
  2. After the retention period expires, the controller will delete personal data.

Recipients of Personal Data (Controller’s Subcontractors)

       1. Personal data recipients are individuals or entities:

  • Involved in the delivery of goods/services and payment processing under the contract.
  • Providing e-shop operation and related services.
  • Providing marketing services.

       2. When transferring your personal data to our processors, we may, in some cases, also transfer personal data to third countries that are not part of the European Union and do not ensure an adequate level of personal data protection. However, such a transfer will only be carried out if our processor               agrees to comply with the standard contractual clauses issued by the European Commission.

Your Rights

  1. Under GDPR, you have the following rights:

    • Right to access your personal data (Article 15 GDPR)
    • Right to rectification of personal data (Article 16 GDPR) or restriction of processing (Article 18 GDPR)
    • Right to erasure of personal data (Article 17 GDPR)
    • Right to object to processing (Article 21 GDPR)
    • Right to data portability (Article 20 GDPR)
    • Right to withdraw consent to processing in writing or electronically using the contact details provided in Section I
  2. Additionally, you have the right to file a complaint with the Data Protection Authority if you believe that your rights regarding personal data protection have been violated.

Security of Personal Data

  1. The controller declares that it has taken all appropriate technical and organizational measures to secure personal data.

  2. The controller has implemented technical measures to secure data storage and paper-based personal data records, including the use of antivirus programs, secure backup storage, and strong access passwords.

  3. The controller states that only authorized personnel have access to personal data.

VIII.

Final Provisions

  1. By submitting an order through the online order form, you confirm that you are aware of the privacy policy and fully accept it.

  2. You agree to these terms by checking the consent box via the online form. By doing so, you confirm that you have read and fully accept the privacy policy.

  3. The controller reserves the right to change these conditions. The updated version of the privacy policy will be published on its website or sent to your email address provided to the controller.
